Terms and Conditions

1. Parties

These Terms and Conditions govern access to and use of CutSports / CutSports Pro (the “Service”), a video analysis and playbook application for macOS available at www.cutsports.app.

The Service is offered by Basketouch Solutions Spain SL (“we” or the “Company”). By purchasing a subscription, downloading the application or using the Service, you accept these Terms in full.

2. Description of the Service

CutSports Pro is macOS software for coaches and staff that enables, among other features:

• Sports video analysis and production.
• List, clip and export management.
• Tactical diagrams and an integrated playbook.
• Licence activation tied to a Mac.

3. Registration and activation

• You must be at least 18 or have authorisation from the entity contracting the Service.
• After purchase you activate the Service with the same email used at checkout. The licence is tied to a Mac (as per the plan).
• Notify us immediately of any unauthorised use of your licence at info@basketouch.com.
• You may not assign or share your licence beyond what the plan allows.

4. Licence and trial

• CutSports Pro is offered as an annual subscription unless the pricing page states otherwise.
• The plan may include a free 30-day trial. When the trial starts you must provide a valid payment method; the annual plan is not charged until the trial ends, unless you cancel earlier.
• The licence is personal, non-transferable and limited to the number of Macs stated in the plan (usually 1).

5. Pricing and billing

• Prices are shown at cutsports.app/en/pricing and include applicable taxes for your country.
• Charges are processed by Paddle as Merchant of Record. By paying you also accept Paddle’s terms.
• Subscriptions renew automatically at the end of each period. You may cancel before the renewal date via the Paddle customer portal.
• After a charge, the Refund Policy applies (14-day withdrawal for EU consumers, subject to legal exceptions for digital services, and Paddle’s terms).
• We may change prices with at least 30 days’ notice. Changes do not affect a period already paid.

6. Acceptable use

The following is expressly prohibited:

• Using the Service for illegal or fraudulent activity.
• Attempting to bypass, disable or manipulate the licensing system.
• Reverse engineering, decompiling or modifying any part of the Service except as allowed by law.
• Reselling, sublicensing or redistributing the Service without written authorisation.
• Deliberately overloading Service infrastructure (DoS attacks, mass scraping, etc.).

7. User content

Videos, projects, diagrams and other files you import or create with the application are your responsibility. You must hold the necessary rights over that content.

• The owner does not claim ownership of your projects or content you produce with the app.
• You are responsible for compliance with applicable law (image rights, third-party data protection, etc.) regarding material you analyse.
• We do not guarantee availability of third-party formats or import flows outside our control.

8. Intellectual property

All software, design, brand, logos and Service content are owned by Basketouch Solutions Spain SL or its licensors. Subscribing does not grant you ownership of the Service.

9. Limitation of liability

The Service is provided “as is”. We do not warrant that it is error-free or continuously available. To the fullest extent permitted by law, our total liability to you will not exceed the amount paid for the Service in the 12 months before the claim arises.

Analysis features support sporting decisions. Final technical decisions remain with the coach or staff.

10. Suspension and cancellation

We may suspend or cancel access if you breach these Terms, with or without prior notice depending on severity. You may cancel your subscription at any time via the Paddle customer portal; access continues until the end of the paid or trial period, as applicable.

11. Governing law and jurisdiction

These Terms are governed by Spanish law. For disputes, the parties submit to the courts of Barcelona, waiving any other venue, except where mandatory consumer law applies.

12. Changes

We may update these Terms periodically. We will notify you by email or via a notice in the app or website at least 15 days in advance. Continued use after the new Terms take effect constitutes acceptance.
